Meaning of Lessee

It is classified as a tenant to an individual who takes a certain thing or service lease. According to DigoPaul, leasing, on the other hand, means giving up, making a transfer or assuming the temporary use of something in exchange for the payment of a certain rate. This means, therefore, that leasing works as a synonym for renting, so the tenant is the subject who takes something in lease.

To give examples of use: “If the lessee does not fulfill his obligations, I am going to evict him”, “The lessee called to advise that tomorrow he will come to pay the rent”, “The lessee company has promised to invest 10% of the income from infrastructure works ”.

In the contracts of leases, the party assumes the role of lessor agrees to transfer the utilization and development of an element (which may be, according to each circumstance, building or furniture) temporarily, to the tenant. The latter, for his part, assumes the commitment to pay a certain price for inhabiting or making use of the furniture, room or house. The payment of this fee can be agreed in different ways among those involved: it can consist of a periodic obligation (called rent or rent) or in a single transaction. Payment can also be made with things equivalent to the price of the product, without money involved.

Let’s look at the case of leasing a home. The landlord gives the keys to the tenant so that he can live in the construction and make use of the facilities in exchange for a monthly payment. The contract will establish many other conditions and will set the duration of this agreement. Typically, the lessee deliver every month a sum of money in cash to the lessor in respect of the lease of the apartment.

Some of the most common conditions when renting a home for personal use is the absolute prohibition to turn it into a commercial store or to carry out illegal activities, such as prostitution. Another important point is that the property or part of it is not sublet, that is, it is not transferred to third parties demanding payment, since it will necessarily be an illegal transaction. While in many cases one or more guarantors are required to certify that tenants are trustworthy, no statement is sufficient, and leasing inevitably results in blind trust in the other.

Another example is when the landlord grants the use and exploitation of a field to the tenant in exchange for a percentage of the crops. One possible arrangement is that if tomatoes were planted in the field, the landlord could demand 30% of the harvest from the tenant.

Solidarity landlords in times of crisis

In an era in which evictions are commonplace, there are people who try to give a helping hand to those who need it most to avoid being forced to live on the street. An example is the campaign that the Bilbao government carried out in September 2012, which consisted of offering shared housing at a symbolic price of 50 euros per tenant, demanding in return that they commit to collaborate in certain social activities.

On the other hand, maintaining the sum of 50 euros, the Valencian municipality of La Alcudia offers through the Toda Ayuda foundation a total of 25 brand-new apartments consisting of two or three rooms to families who have been victims of eviction. These are apartments that have been for sale for more than a year and that have been granted by their owners for use in this proposal.
